The short version
The agreement
These terms apply when you create an account, start a trial or pay for TowSitePros. If you are agreeing on behalf of a company, you are confirming that you can bind that company. If you do not agree, do not use the product.
What we provide
A hosted towing company website, and the software behind it: the job record, the dispatch board, driver job links, customer texts and the customer tracking page, reviews, reports, an API and webhooks. What is included is listed on the pricing page and that list is the one checkout uses.
What we do not provide, so it is in writing: card processing, motor club digital dispatch, impound and lien processing, and private-property patrol. A quote recorded on a job is information for your customer. An invoice or receipt raised on a job is a document for your customer, not a payment: payment is taken through whatever pay-online link you supply, and TowSitePros does not process card payments or hold your customers' money.
Trial, billing and cancellation
- The trial runs for 7 days. Your card is set up at sign-up so the account keeps running afterwards, nothing is charged during the trial, and cancelling before it ends costs you nothing.
- After the trial the subscription is $99 per month per site, charged monthly in advance through Stripe.
- There is no contract, no minimum term and no cancellation fee. Cancel from your account settings at any time and the subscription runs to the end of the period you have paid for.
- The price your subscription starts on is the price it keeps while it stays active. If we change what new customers pay, that applies to new customers.
- Taxes, where they apply, are added at checkout.
Refunds are handled case by case. If something went wrong on our side, write to us and we will sort it out rather than point at a clause.
What you are responsible for
- The accuracy of what you publish: your services, your coverage, your hours, your prices and any licensing or insurance statement you choose to put on your site. We do not verify these and we do not assert them on your behalf.
- The towing work itself. We are software. We do not dispatch your trucks, employ your drivers or perform any service for your customers.
- Having the consent you need before your customers are texted. See the section below.
- Keeping your account credentials safe, and who you give access to. Users and drivers are unlimited, which means access is yours to manage.
- Not using the product to break the law, send unsolicited messages, or store data you have no right to hold.
Customer consent for text messages
Consent for text messages to your customers belongs to you, not to us. You collect it, you hold the record of it, and you carry the responsibility for it. Texting cannot be switched on in the product until you have confirmed that in writing, and that confirmation is timestamped and kept.
We honour STOP and the other standard opt-out words automatically, regardless of who is liable, because carriers require it. Where texts go through your own GoHighLevel number, the sender registration and the sending reputation are yours as well.
Who owns what
Your domain, the content you write, your logo and photographs, your job records and your customer data are yours. Nothing here transfers ownership of them to us. You grant us only the permission we need to host, display, back up and process them so the product can work.
The software, the site designs and the TowSitePros name are ours. You get the right to use them while your subscription is active. You may not copy the software or resell access to it.
If you tell us what a towing shop needs and we build it, we own the feature, and you owe us nothing for having said so.
Leaving, and what happens to your data
You can leave whenever you like and take your things with you: point your domain wherever you want, export every report to CSV and pull every job out through the API. Ask us and we will help rather than slow it down.
When an account is closed we stop serving the site and we delete or anonymise the account's data, except where we are required to keep a billing record. Export what you want before you close it.
We may suspend or close an account that is not paid for, that is being used to break the law, or that is putting the platform or other customers at risk. Except in an emergency we will tell you first and say why.
Availability
We work to keep the product running and we fix things quickly, but we do not offer a service level agreement, an uptime commitment or a status page, and we are not going to pretend we do. Our security page says exactly what is and is not in place, and support states the response time we can actually honour.
The product is provided as it is. We do not warrant that it will be uninterrupted or error free, and we are not liable for lost profits, lost business or indirect losses. Nothing in these terms limits any liability that cannot lawfully be limited.
Changes to these terms
If we change these terms we will change the date at the top, and we will email account holders before a material change takes effect. Carrying on using the product after that is how you accept the change; if you do not want to, cancel.
